The cost of long-term care can destroy a lifetime of savings in a matter of months. Many families mistakenly believe they have only two options: pay out of pocket until they are completely broke or rely on a nursing home right away. Fortunately, you can protect your hard-earned assets and secure high-quality care, but only if you understand the strict legal frameworks governing long-term care.
4 Keys to Safeguarding Your Wealth
Proactive Medicaid Planning: Medicaid is a primary payer for long-term nursing home care, but it is heavily means-tested. This means that if your income or assets exceed strict state limits, you will be disqualified. Proactive planning restructures your assets legally so you can qualify without sacrificing your entire life savings.
The Five-Year Look-Back Period: You cannot simply give your money away when you need care. When you apply for institutional Medicaid, the state reviews all financial transactions, gifts, and asset transfers over the previous 60 months (5 years). Any transfers deemed improper trigger an immediate “penalty period,” leaving you temporarily ineligible and forced to pay out of pocket.
Medicaid Asset Protection Trusts (MAPTs): A MAPT is a powerful irrevocable trust designed specifically to shield your wealth. By placing savings, investments, or real estate into a MAPT, those assets no longer count toward your Medicaid limit once the five-year look-back clock expires. While you cannot access the principal directly, you can retain the legal right to live in your home and, depending on where you live, still receive income generated by the trust.
Protecting the Family Home: Your house is often your most valuable asset and the most vulnerable. While a primary residence may be temporarily exempt from counting toward your initial eligibility, it is highly vulnerable to estate recovery after you pass away. In other words, the state can force a sale to pay itself back. Transferring the home into a MAPT or utilizing specific family exemptions can permanently protect your home for your children.
The Tax Myth Alert: Many people believe they can safely gift up to $19,000 per year under the IRS gift tax exemption. This is a tax rule, not a Medicaid rule. Gifting any amount to your children within the five-year window will trigger a severe Medicaid penalty.
Don’t Wait for a Medical Crisis to Protect Your Assets. The protective power of a trust requires time. If you wait until nursing home care is an immediate necessity, your options become severely limited. Taking action early ensures your home and savings stay exactly where they belong: with your family.
